These Terms of Service ("Terms") govern your access to and use of the InstaCapture mobile application (the "App") provided by InstaCapture ("we," "our," or "us").
By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
InstaCapture is a mobile app for capturing, organizing, editing, and exporting videos. Features may include camera recording, clip management, on-device video editing, captions and transcripts, shot-list planning, and optional on-device shot-list generation on supported devices.
We may add, change, or remove features over time.
You must be able to form a binding contract in your jurisdiction to use the App. If you are under the age required in your location, you may use the App only with permission from a parent or legal guardian.
You retain ownership of the videos, audio, images, notes, captions, and other content you create or import into the App ("User Content").
You are solely responsible for User Content and for ensuring that:

We may suspend or terminate access if we reasonably believe you have violated these Terms.
InstaCapture is designed to process most User Content on your device. Certain features rely on Apple system services, including speech recognition and, on supported devices, Apple Intelligence.
When you use the iOS share sheet, photo library, or other system integrations, those services are provided by Apple or third parties under their own terms and policies.
InstaCapture is a creative tool. It does not provide legal, safety, journalistic, or professional production advice. You are responsible for how you capture and publish content.
The App, including its design, branding, and underlying software (excluding your User Content), is owned by InstaCapture or its licensors and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms, unless we agree otherwise in writing.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with every device, format, or workflow.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTACAPTURE AND ITS OWNERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless InstaCapture from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the App, or your violation of these Terms or applicable law.
If you downloaded the App from Apple's App Store, your use is also subject to Apple's applicable terms, including the Licensed Application End User License Agreement. Apple is not responsible for providing maintenance or support for the App.
We may modify the App or these Terms at any time. If we make material changes, we will post the updated Terms and update the "Last Updated" date.
Your continued use after changes become effective constitutes acceptance of the revised Terms.
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you violate these Terms or if we discontinue the App.
Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnification.
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where mandatory local consumer protection laws apply.
